By booking an appointment and purchasing media from Legacy Property Media, you acknowledge and agree to the following terms. These terms are legally binding and govern the use of all services provided.

 

1. Property Readiness

Clients are responsible for ensuring the property is fully prepared before the scheduled shoot. A preparation checklist will be provided in advance. If the property is not ready upon arrival, the shoot will proceed as scheduled. Legacy Property Media is not obligated to reshoot due to cleanliness, staging, lighting, or other subjective conditions. Preferred shots or angles may be submitted prior to the appointment. In the absence of direction, Legacy Property Media will determine compositions at its discretion. If essential spaces are unintentionally omitted (e.g., garage, closets), a complimentary reshoot may be arranged. Reshoots requested for aesthetic reasons or alternate angles will require a new paid booking.

2. Booking, Rescheduling & Cancellations

Appointments must be scheduled at least 12 hours in advance to ensure availability.

Reschedules or cancellations may be made at any time and are not subject to any fees. Legacy Property Media understands that real estate timelines move quickly and aims to remain as flexible and accommodating as possible. If weather conditions prevent exterior photo or video (e.g., heavy rain, fog, or wind affecting drone operations), interior media will still be captured as planned, and a separate appointment for exterior content will be scheduled at no additional cost. Legacy Property Media is not responsible for delays caused by traffic, equipment issues, or other events outside of its control.

 

3. Payment Terms & Fees

Full payment is required before media can be accessed or downloaded. For clients with invoicing arrangements (e.g., brokerages), payment is due by the agreed-upon date. All sales are final once services have been rendered, regardless of download status.Initiating a chargeback or dispute after delivery may result in legal action to recover all fees, including attorney’s fees.

 

4. Service Area & Travel Fees

Services are available within a 50-mile radius of Conway, Arkansas, at no additional cost. A $25 travel fee applies to locations outside the standard service area but within Arkansas. Out-of-state bookings may be considered on a case-by-case basis and will be subject to custom travel rates.

 

5. Turnaround Time & Delivery

Standard delivery time is within 24 hours, but this may vary depending on workload and project complexity. Media is delivered digitally through an online platform. Access is granted only after payment has been received in full.

 

6. Media Rights & Usage

All media is the sole property of Legacy Property Media unless otherwise stated in a signed agreement. Clients receive a limited, non-exclusive license to use the media for marketing the specific listing photographed. This license expires when the property is sold, taken off-market, or after one year—whichever comes first. Media may not be resold, transferred, or licensed to any third party without written permission. Media may not be reused to list a property under a different agent or brokerage. Editing, altering, or repurposing the content without written approval is strictly prohibited. Legacy Property Media reserves the right to use any content for promotional, portfolio, website, or social media use without additional consent.

 

7. Liability & Indemnification

Clients must have proper authorization to permit filming/photography of the property. Legacy Property Media is not responsible for any disputes related to property access or ownership. Clients agree to indemnify and hold harmless Legacy Property Media and its affiliates against any claims, losses, or legal issues arising from; disputes over access, ownership, or representation; Unauthorized use or distribution of the media; Any damages or legal consequences resulting from misuse of the content.

 

8. Agreement & Enforcement

By booking a session, you confirm that you have read and agreed to these terms in full. These terms form a legally binding agreement, enforceable under the laws of the State of Arkansas.
